CALL TO ORDER 

Chair Spahn called the meeting to order at 9:00 a.m.

Review and approval of the minutes of March 29, 2007

 

In a motion by Gilmore, seconded by Spelke, to accept the minutes of March 29, 2007 as written.  Motion carried.

Complaint Officer’s Report

2007 VET 3397 Initial presentation

In a motion by Spelke, seconded by Gilmore, to dismiss 2007 VET 3397 on the basis of no evidence of a violation of Board’s Laws and Rules.  Motion carried, Complaint Officer Pesut recused.  Dennis Smith, AAG was Board Attorney for this case.

 

2007 VET 3399 Initial presentation

In a motion by Spelke, seconded by Gilmore, to dismiss 2007 VET 3399 on the basis of no evidence of a violation of Board’s Laws and Rules.  Motion carried, Complaint Officer Pesut recused.  Dennis Smith, AAG was Board Attorney for this case.

 

2007 VET 3478 Initial presentation

In a motion by Pesut,  seconded by Gilmore, to dismiss 2007 VET 3478 on the basis of no evidence of violation of Board’s Laws and Rules.  Motion carried, Complaint Officer Beever, recused. 

 

2007 VET 3318 Initial presentation

In a motion by Spelke, seconded by Gilmore, to dismiss 2007 VET 3318 on the basis of no evidence of violation of Board’s Laws and Rules.  Motion carried, Complaint Officer Pesut, recused.

 

2007 VET 3307 Initial presentation

In a motion by Spahn, seconded by Gilmore, to dismiss 2007 VET 3307 with a letter of guidance regarding patient care.  The letter is to be on file for a period of ten years.  Motion carried, Complaint Officer Pesut, recused.

 

2007 VET 3447 Initial presentation

In a motion by Spelke, seconded by Gilmore, to dismiss 2007 VET 3447 on the basis of no violation of Board’s Laws and Rules.  Motion carried, Complaint Officer Pesut, recused.

 

2007 VET 3347 Initial presentation

In a motion by Gilmore, seconded by Spelke, to dismiss 2007 VET 3347 with a letter of guidance regarding appropriate use of offering further diagnosis.  The letter is to be on file for a period of five years.  Motion carried, Complaint Officer Pesut, recused.

 

2007 VET 3354 Initial presentation

In a motion by Spelke, seconded by Gilmore, to dismiss 2007 VET 3354 on the basis of no violation of Board’s Laws and Rules.  Motion carried, Complaint Officer Pesut, recused.

 

2007 VET 3359 Initial presentation

In a motion by Beever, seconded by Gilmore, to dismiss 2007 VET 3359 on the basis of no evidence of violation of Board’s Laws and Rules.

Motion carried, Complaint Officer Pesut, recused.

 

2006 VET 3056 Update

In a motion by Gilmore, seconded by Spelke, to offer an amended consent agreement to 2006 VET 3056 as discussed.  Motion carried, Complaint Officer Pesut recused.

Program Administrator’s Report

Subpoena Authority

In a motion by Gilmore, seconded by Pesut, to delegate authority of issuing subpoenas to the Board Administrator or her designee in accordance with 10 MRSA § 8003.  Motion carried. 

 

Legislative Update

Ms. Betts provided the Board with information regarding the legislative decision to attach dedicated revenues.

 

Ms. Betts informed the Board that license renewals are now online.

 

Correspondence

Facsimile of May 18, 2007, Cathy Cleaveland, regarding the take home prescription medications

In a motion by Pesut, seconded by Gilmore, to table action pending receipt of an answer from the Board of Pharmacy.  Motion carried.

There being no further business, Pesut, motioned to adjourn at 12:38 p.m. seconded by Spelke.  Motion carried.
