CALL TO ORDER 

Chair Spahn called the meeting to order at 9:00 a.m.

OLD BUSINESS

Review and approval of the minutes of December 13, 2006

In a motion by Gilmore, seconded by Spelke, to approve the minutes of December 13, 2006, as amended.  Motion carried.

 

NEW BUSINESS

 

Complaint Officer’s Report

2006 VET 3058 Initial presentation

In a motion by Spelke, seconded by Gilmore, the Board determined evidence exists to substantiate a possible violation of the 32 M.R.S.A. § 4864 (2).  Motion carried. 

 

 

In a motion by Spelke, seconded by Gilmore, to schedule 206 VET 3058 for an adjudicatory hearing; in lieu of an adjudicatory hearing the board is offering a consent agreement including but not limited to the following terms:  1)  Admission to violation of 32 M.R.S.A. § 4864 (2); 2)  Fine of $500.00 per violation (totaling $1,000.00), fine to be paid no later than sixty (60) days of fully executed consent agreement; and 3)  Warning.  Motion carried, Complaint Officer recused.

 

2006 VET 3043  Initial presentation

In a motion by Beever, seconded by Gilmore, to dismiss 2006 VET 3043 with a letter of guidance regarding the necessity for all practitioners, regardless of practice type to meet record keeping standards.  The letter of guidance is to be on file for a period of ten (10) years.  Motion carried, Complaint Officer recused.

 

2006 VET 3190 Initial presentation

In a motion by Spelke, seconded by Beever, to dismiss 2006 VET 3190 on the basis of no evidence of a violation of Board’s Laws and Rules.  Motion carried, Complaint Officer recused.

 

2006 VET 3191 Initial presentation

In a motion by Beever, seconded by Gilmore, to dismiss 2006 VET 3191 on the basis of no evidence of a violation of Board’s Laws and Rules.  Motion carried, Complaint Officer recused.

 

2005 VET 274 Update

In a motion by Benson, seconded by Spelke, to table action on 2005 VET 274 to the August meeting.  Motion carried, Complaint Officer recused.

 

2006 VET 3056 Initial presentation

In a motion by Spelke, seconded by Gilmore, the Board determined that evidence exist to substantiate a possible violation of Board’s Laws and Rules.  To schedule 2006 VET 3056 for an adjudicatory hearing; in lieu of an adjudicatory hearing the Board is offering a consent agreement including but not limited to the following terms:  1) admission to violation of 32 M.R.S.A. § 4864 (14) and Board Rules Chapter 5 Section 2; 2) reprimand; and 3) probation for a two (2) year period, to include submission of five (5) surgical and medical records for review quarterly totaling forty (40) records.  Motion carried, Complaint Officer.

 

2006 VET 3154 Initial presentation

In a motion by Gilmore, seconded by Spelke, to dismiss 2006 VET 3154 on the basis of no violation of Board’s Laws and Rules.  Motion carried, Complaint Officer recused.

 

2006 VET 3203 Initial presentation

In a motion by Benson, seconded by Gilmore, to dismiss 2006 VET 3203 on the basis of no violation of Board’s Laws and Rules.  Motion carried, Complaint Officer recused.

 

2005 VET 274 Update

In a motion by Benson, seconded by Spelke, to table action on 2005 VET 274 to the August 2007 meeting.  Motion carried, Complaint Officer recused.

 

 

2004 VET 236 Update

In a motion by Benson, seconded by Gilmore, to close 2004 VET 236 as meeting all terms of the consent agreement.  Motion carried, Complaint Officer.

 

Correspondence

Facsimile of December 11, 2006, Brion Reagor, regarding release of vaccination history

In a motion by Beever, seconded by Gilmore, to send a reply to Dr. Reagor indicating that generally speaking staff members are not allowed to disclose vaccination history but exceptions do exist.  Licensees are encouraged to seek their own private attorney for an explanation of obligations to the Laws and Rules.

 

Election of Officers

Chair

In a motion by Beever, seconded by Benson, to nominate and elect Dr. Spahn as Chair.  Motion carried.

 

Complaint Officer

In a motion by Spahn, seconded by Spelke, to nominate and elect Beever as Complaint Officer.  Motion carried.

 

Medical Records Reviewed

In a motion by Spahn, seconded by Benson, to nominate and elect Spelke as the Board Member to review medical records submitted as required by disciplinary actions.  Motion carried.

 

Continuing Education Officer

In a motion by Beever, seconded by Gilmore, to nominate and elect Benson as Continuing Education Officer.  Motion carried.

 

Program Administrator’s Report

In Administrator Betts’ absence no report was given.

There being no further business, Benson, motioned to adjourn at 12:37 p.m. seconded by Gilmore.  Motion carried.
