Minutes of December 13, 2006 Board Meeting

 

CALL TO ORDER

Chair Spahn called the meeting to order at 8:20 AM

OLD BUSINESS

Review and approval of the minutes of October 5, 2006

In a motion by Spelke, seconded by Beever, to accept the minutes of October 5, 2006, as presented. Motion carried, Gilmore abstained.

NEW BUSINESS

Review Decision and Order VET 2357 – Justin Blake

In a motion by Spelke, seconded by Beever, to accept the Decision and Order as presented. Motion carried, Complaint Officer recused and Gilmore abstained.

Adjudicatory Hearing – 2005 VET 273 – Clifton Temm

In a motion by Gilmore, seconded by Beever, to accept the consent agreement in the matter of 2005 VET 273 as presented including but not limited to the following: 1) Admission to violations of 32 M.R.S.A. § 4864 (11) and (14), Board Rules Chapter 5 Section 2 and Chapter 7 Sections 1 and 22; 2) Reprimand; 3) Thirty (30) days suspension for each violation for a total of ninety (90) days with all suspended for successful completion of probation period; 4) Probation for a period of five (5) years; 5) Fine of $1,500.00 for each violation totaling $4,500.00 ($500.00 of each of the three fines is suspended for successful completion of probation period); 6) Four (4) additional hours of pre-approved continuing education in ethics to be completed within one year; 7) Plan of action regarding patient treatment, communications with clients and staff, and records maintenance is to be submitted within six (6) months; and 8) Provide a total of forty (40) medical records, two (2) records quarterly for period of probation. Motion carried, Complaint Officer recused.

Board Action on Licensure Application – Dr. Deme Erickson

In a motion by Spelke, seconded by Gilmore, to preliminary deny Deme Erickson’s veterinary application with an offer of a consent agreement including but not limited to the following: 1) Admission to violation of 32 M.R.S.A. §§ 4860 and 3863; 2) $100.00 fine; and 3) Waive the jurisprudence examination. Motion carried.

 

Complaint Officer’s Report

2006 VET 2938 Initial presentation

In a motion by Beever, seconded by Gilmore, to dismiss 2006 VET 2938 on the basis of no violations of Board Laws and Rules. Motion carried.

2006 VET 3058 Initial presentation

This item is table to a future meeting.

Dr Benson arrives and expresses his apologies.

 

2006 VET 2776 Initial presentation

In a motion by Benson, seconded by Spelke, determine that evidence exist to substantiate a possible violation of Board Rules Chapter 5 Section 2 and Chapter 7 Section 23. Motion carried, Compliant Officer recused.

In a motion by Spelke, seconded by Benson, to offer a consent agreement to 2006 VET 2776 including but not limited to the following: 1) Admission to violation of Board Rules Chapter 7 Section 23 and Chapter 5 Section 2; 2) Warning; 3) Twelve (12) hours of additional continuing education, six (6) anesthesia and (6) surgery to be completed within two (2) years; 4) Provide five (5) surgical and medical records quarterly for a two (2) year period totaling forty (40) cases. Failure to accept the consent agreement as presented will result in the matter being scheduled for an adjudicatory hearing. Motion carried, Complaint Officer recused.

2006 VET 3000 Initial presentation

In a motion by Benson, seconded by Spelke, to dismiss 2006 VET 3000 on the basis of no violation of Board’s Laws and Rules. Motion carried, Complaint Officer recused.

2006 VET 3029 Initial presentation

In a motion by Benson, seconded by Beever, to dismiss 2006 VET 3029 as the matter has previously been disposed of by the Board. Motion carried, Complaint Officer and Gilmore recused.

2006 VET 3036 Initial presentation

In a motion by Benson, seconded by Gilmore, to dismiss 2006 VET 3036 on the basis of no violation of Board’s Laws and Rules. Motion carried, Complaint Officer.

2006 VET 3060 Initial presentation

In a motion by Beever, seconded by Gilmore, to dismiss 2006 VET 3060 on the basis of no violation of Board’s Laws and Rules. Motion carried, Complaint Officer.

2006 VET 2547 Initial presentation

In a motion by Benson, seconded by Spelke, to dismiss 2006 VET 2547 on the basis of no violation of Board’s Laws and Rules. Motion carried, Complaint Officer Spahn and Pesut recused.

Program Administrator’s Report

Ms. Betts updated the Board on the legislative changes being proposed by the Department. As well as informed the Board that the proposed changes to the OLR Fee Rule are being sent to all members and interested parties.

Emergency Clinics discussion

The Board will notify licensee that supervision and/or ownership of clinics can be held accountable to the Board for policies that may directly affect the patient care.

There being no further business, Beever, motioned to adjourn at 2:08 p.m. seconded by Benson. Motion carried.
