CALL TO ORDER
Chair Spahn called the meeting to order at 9:02 AM

OLD BUSINESS
In a motion by Pesut, seconded by Beever, to accept the minutes of December 14, 20005 as written. Motion carried, Benson abstained.
NEW BUSINESS
- Adoption of Proposed Rules
In a motion by Pesut, seconded by Beever, to adopt the amendments to Chapter 1, including the basis statement and response to comments; to adopt the repeal and replace of Chapter 2 including the basis statement and response to comments; and to adopt the amendment to Chapter 3 including the basis statement and response to comments as presented to the Board dated April 19, 2006. Motion carried.

In a motion by Beever, seconded by Chandler, to dismiss 2005 – VET – 2324 on the basis of no evidence of violation of Board’s Laws and Rules. Motion carried, Complaint Officer recused.

In a motion by Benson, seconded by Chandler, to dismiss 2005 – VET – 2325 on the basis of no evidence of violation of Board’s Laws and Rules. Motion carried, Complaint Officer recused.

In a motion by Chandler, seconded by Beever, to dismiss 2005 – VET – 280 on the basis of no evidence of violation of Board’s Laws and Rules. Motion carried, Benson and Complaint Officer recused.

In a motion by Beever, seconded by Chandler, to dismiss 2005 – VET – 278 and 2005 – VET – 2060 on the basis of no evidence of violation of Board’s Laws and Rules. Motion carried, Complaint Officer recused.
- 2005 VET 2357 Initial presentation
In a motion by Benson, seconded by Chandler, to determine that the evidence as presented could support potential violations of 32 M.R.S.A. § 4864 (7)and (11), Board Rules Chapter 5 Section 2, Chapter 7 Sections 17 and 23 in the matter of 2005 VET 2357. Motion carried, Complaint Officer recused.In a motion by Benson, seconded by Beever, to offer a consent agreement to 2005 – VET – 2357 including but not limited to the following: 1) Admission to potential violations as stated in previous motion; 2) reprimand; 3) $1,000.00 fine to be paid within thirty (30) days of accepting the consent agreement; 4) twelve (12) hours of additional continuing education in critical care to be completed within twelve (12) months; and 5) to submit four (4) randomly selected records (two (2) each of non routine surgical and medical cases) quarterly for a period of two (2) years totaling thirty-two (32) cases. Failure to accept the consent agreement as offered will result in the matter being scheduled for an adjudicatory hearing. Motion carried, Complaint Officer recused.
- 2005 VET 2228 Initial presentation
In a motion by Spahn, seconded by Beever, to dismiss 2005 – VET – 2228 with a letter of guidance on massage therapy and correctly advertising of services provided. The letter of guidance is to be on file for a one year period. Motion carried, Complaint Officer

In a motion by Spahn, seconded by Benson, to table 2005 – VET – 2049 pending further investigation. Motion carried, Complaint Officer recused.In a motion by Benson, seconded by Spahn, to add to the agenda Board action on veterinary technician examination application for Kathleen McCabe. Motion carried.In a motion by Spahn, seconded by Chandler, to approve the education as presented by Kathleen McCabe application for veterinary technician. Motion carried.

There being no further business, Benson motioned to adjourn at 1:01 PM seconded by Pesut. Motion carried.
