Summary: Licensee had administered a vaccination to a cat. Licensee committed malpractice in the premature discharge of the cat after the cat’s presentation with open-mouthed breathing. Since the cat needed oxygen and was quite ill after his initial treatment, the cat should have been monitored by licensee or another individual(s) trained in veterinary medicine. Additionally, there was no significant effort to confidently rule out the other differential diagnoses so what the cat suffered from and died as a result of is still unknown. The unexpected death should have triggered a more thorough investigation to determine the cause of death for both the owner and veterinarian’s benefit. It was unprofessional for licensee to offer to perform the necropsy and then fail to submit tissue samples for pathological analysis as a part of that procedure since his findings on gross observations did not produce a determinative conclusion. If a more detailed necropsy had been performed, a cause of death may have been found or at least the other diagnoses ruled out, in which event this hearing might not have been necessary. The lack of adequate recordkeeping caused many problems in this matter both to the owners and veterinarian. For example, there is no record of the cat’s temperature at various times during his second visit, and neither is there at any time reflected when the cat’s gums returned to a normal color or when his capillary refill took place. If these occurred close to the time before discharge, then the need to retain the cat for further monitoring would have been clear to licensee and any veterinarian reviewing the cat’s treatment.

The board reprimanded licensee, put licensee on probation for two years, fined licensee $1000, ordered licensee to complete twelve hours of continuing professional veterinary education in emergency care, ordered licensee to provide the board quarterly with copies of two medical and two surgical records for review for a period of two years, and ordered licensee to pay $2852.50 hearing costs.

Summary: Four complaints were filed against Dr. Hahnel. One complaint alleged incompetence in euthanizing a dog. One complaint alleged misdiagnosis and incorrect treatment of a cat. One complaint alleged inability to practice due to physical, psychological or mental impediment, and poor sanitation in Dr. Hahnel's veterinary clinic. One complaint alleged poor sanitation in Dr. Hahnel's veterinary clinic, and severe neglect and resulting poor physical condition of the animals resident in the clinic. This last complaint was filed following the seizure of 15 cats and 6 dogs from Dr. Hahnel's clinic by a veterinarian from the state animal welfare program.

During the pendency of these complaints, Dr. Hahnel's veterinary license came due for renewal. On 12/14/05 the board preliminarily denied the renewal applications on the ground "that Dr. Hahnel is presently unable to practice veterinary medicine because she has been diagnosed with a long-standing mental illness which currently prevents her from applying principles and/or skills necessary to carry out the practice of veterinary medicine, and which illness has, at various times in the past, led to complaints being filed or initiated against her veterinary license and the summary suspension of her veterinary license." Upon Dr. Hahnel's failure to appeal the preliminary denial, the board notified Dr. Hahnel on 1/23/06 that the preliminary denial became final, and that her license expired effective 1/16/06.

The board made no final findings on any of the complaints filed against Dr. Hahnel. If Dr. Hahnel applies for relicensure in the future, the board may consider the complaints at that time.

Summary: Licensee is a veterinary surgeon who accepted a referral from a general practice veterinarian of a 50 pound Belgian Tervuran with a limp in his right rear leg. Proper exercise of licensee's skills as a specialist should have enabled him to detect a lytic lesion in the leg on two sets of x-rays taken in June 2001. Additionally, the x-rays revealed evidence that something unusual was occurring regarding the dog's leg and, at the least, licensee should have later suspected that his original diagnosis may have been mistaken, especially after being informed before January 23, 2003 that the dog's condition had not improved. Licensee should have engaged in a more thorough follow-up of his diagnosis of the dog's condition. Additionally, experts are more highly trained to discover abnormalities, even though the lytic lesion was in an unusual location.

The board issued a reprimand to licensee, ordered licensee to complete 12 hours of continuing education in radiography, and ordered licensee to pay $1501.50 hearing costs.

Licensee admitted that the foregoing conduct, that was based upon her reliance on her clinical experience and on her misreading of the pathology report (in spite of the pathology report of "[m]ast cell tumor, grade 2"), warrants some form of discipline.

Licensee agreed to a $500 civil penalty. Licensee also agreed to obtain 12 clock hours of continuing professional veterinary education in the areas of surgery and oncology.

Summary: A horse owner telephoned licensee's office on a Wednesday morning and told the receptionist that her horse was down, described the animal's condition, and requested a house call. The receptionist told the owner to bring a fecal sample to licensee's office. The owner brought a sample to the office. The licensee tested the sample, which did not explain the horse's condition. The owner repeated her request for a house call. The licensee instead gave her some medication for the horse, told her to call him back if the horse continued to have problems, but neglected to mention that he routinely takes Wednesday afternoons off. Later that morning the owner was still unable to get the horse to stand. She called a series of three telephone numbers but was unable to reach licensee. The owner stayed up all night with her horse, and made the decision to euthanize him the next morning. She then phoned licensee who arrived at around 3:15 PM and did as requested.

The board found that the owner was a client of the licensee. The board further decided that the situation as presented to the licensee indicated that an emergency existed in regards to the horse and that he did not respond in a timely manner. The board further found that the prescribing of medicine was not an appropriate response particularly since he had not examined the animal and had not formed a diagnosis. Additionally, licensee failed to record the medicine prescribed or the reason for the prescription. Moreover, he advertised that emergency services are available when, in fact, those services are only available to clients.

The board, after considering prior disciplinary action that it had taken against licensee, issued a reprimand to licensee, ordered licensee to complete twelve hours of continuing education in large animal diagnosis and treatment, ordered licensee to change his advertising to reflect that emergency services are available only to clients, and ordered licensee to pay $667.36 hearing costs.

Licensee's motion to withdraw the stipulation of fact and admission to violations was denied. Following a dispositional hearing, licensee was issued a 6 month suspension and ordered to pay $4,978.34 in costs incurred by the board. Licensee was put on probation for 2 years, during which time he must complete 12 hours of continuing professional education which address ethics, animal restraint and animal behavior and be evaluated by a psychologist and/or psychiatrist. The board shall determine counseling requirements following receipt of the evaluation and may extend the period of probation based on the results of counseling and the conditions of probation. Licensee shall appear in person before the board every 6 months at a regular board meeting unless otherwise ordered. The board may require ongoing supervision of licensee if his license is renewed.

Summary: On December 4, 2001, the board and licensee entered into a consent agreement in which licensee agreed, as a condition of probation, to comply with all support obligations as required by the Department of Health and Human Services. The penalties in the consent agreement included a 6 month license suspension that was itself suspended unless licensee violated probation. On May 31, 2002, the board received a "Certification to Revoke License" from the Department of Human Services for licensee's failure to meet the terms of an existing child support order. As a result, the board revoked Dr. Hill's license on June 5, 2002.

In this proceeding, the board concluded that licensee violated the terms of the December 4, 2001 consent agreement. The board: (a) issued licensee a reprimand, (b) removed the suspension of the 6 month license suspension contained in the December 4, 2001 consent agreement by suspending Dr. Hill's license for the 6 month period beginning on September 4, 2002, (c) extended licensee's probation until February 9, 2005, at which time his daughter will attain the age of 18 years, and (d) ordered licensee to pay $530.25 in costs incurred by the board.
