Summary: Licensee admitted that prior to February 2002 she received a used hearing aid as a charitable donation. In February 2002 she sold a purportedly new hearing aid to a consumer for $1200. The hearing aid that licensee sold to the consumer was, however, the used hearing aid, which had first been sold in 1992. When the consumer purchased the used hearing aid from licensee, he believed he had purchased a new hearing aid. Although she states that her failure was negligent and not intentional, licensee failed to furnish the consumer with required notice regarding the make, model, terms of sale and warranty prior to or at the time of the hearing aid purchase. Licensee agreed to a reprimand, a $1000 civil penalty and a 6-month probation, during which time she agreed to comply with unannounced inspections of her practice, including inspection and copying of records, the cost of which shall be borne by licensee. Licensee also agreed to pay reasonable investigative costs not to exceed $1000.

Licensee agreed to a warning and probation. Conditions of probation are that licensee: (a) complete a mentorship/remediation program of at least 16 hours duration; (b) submit five records per month to the board for review for the six months following successful completion of the mentorship/remediation program; and (c) revise and update the purchase and sale agreement that she provides to clients.

Summary: Licensee admitted that there is sufficient evidence for the board to find that he committed the following violations: (a) failed to provide the customer with a full refund during the trial period, to wit: licensee kept $200 that should have been returned to the customer as the governing statute permits a dealer to retain only "the reasonable price of the ear mold or molds and lab fees," which in this case amounted to $30; (b) failed to provide a written notice to the customer that included the board's address; (c) aided and abetted the unlicensed practice of fitting and selling hearing aids by allowing an unlicensed technician to select and adapt the customer's hearing aid; and (d) failed to obtain the customer's signature on a medical waiver.
Licensee agreed to a reprimand, a warning and a $200 civil penalty. Licensee also agreed to refund $200 to the customer, and to revise and update the purchase and sale agreement that he provides to clients.
