Summary: Licensee arrived at a modular classroom building to observe a 3-year-old preschool client in a classroom setting. A bathroom was located between the client's classroom and another classroom. The bathroom doors on either side were Dutch doors, both parts of which swing into the classrooms. Licensee urinated in the bathroom without closing the upper half of the door that separated the bathroom from the client's classroom. Licensee violated applicable ethical standards by intentionally misrepresenting that the client was not in the client's classroom when licensee urinated with the upper door open. Licensee also committed misrepresentation in testifying differently at hearing, in some respects, in comparison to his earlier written response to the complaint. Licensee's conduct adversely reflected on the professions of speech-language pathology and audiology, although his conduct did not impact on his fitness to serve persons professionally.
The board issued licensee a warning and placed licensee on probation. The condition of probation is that licensee participate in counseling regarding his poor personal judgment in the professional workplace. Licensee shall attend two counseling sessions per month. Counseling shall continue until the counselor submits written confirmation to the board that licensee had satisfactorily achieved the goals of the counseling.
