Summary: On July 5, 2006 the board preliminarily denied the application for licensure as a respiratory therapist. The preliminary denial was based on action taken against the applicant's New Hampshire pharmacist and respiratory care practitioner licenses by the New Hampshire licensing boards. In those proceedings, the applicant had admitted to being chemically dependent, stealing narcotics from his employer, and consuming narcotics while on duty as a pharmacist. In addition, applicant failed to disclose the consent agreement with the New Hampshire Board of Pharmacy when he applied for licensure as a Maine respiratory therapist in 2003 and when he renewed that license in 2004. Licensee did not request a hearing on the preliminary denial, and the preliminary denial became final on August 9, 2006.

Summary: Licensee's employer discharged licensee for cause due to chronic and serious misconduct and lack of confidence in licensee's ability to perform the duties of the job. Following investigation, the board on June 23, 2005 preliminarily denied licensee's application for licensure as a respiratory care therapist on the grounds that licensee failed to execute physicians' orders, failed to follow patient treatment plans and did not notify the physicians or supervisors of those failures. Licensee was sent written notice of the preliminary denial by letter dated June 29, 2005. Licensee did not respond during the applicable appeal period (30 days from receipt of the written notice), and the preliminary denial automatically became final on July 31, 2005.
