Summary: Licensee acknowledged that he is the operator of a physical therapy facility. A review of documentation of licensee's facility's treatment of MaineCare patients in 2003 and 2004 revealed that licensee's documentation lacked the objectivity and quantification necessary to establish the medical necessity for treatment and measurable progress of treatment towards goals. Subsequent to the documentation deficiencies being identified for licensee, licensee engaged a consultant to attempt to review and improve his pattern of documentation.

Licensee agreed to a warning and a 1-year probation. During the probation period, licensee's physical therapy practice will be subject to consultation by a physical therapist or occupational therapist. (See the consent agreement for details of the consultant's reporting obligations.) In addition, during the period of probation the board may randomly select up to five patient files per request to be redacted and copied for the board for its review in consideration of licensee's ongoing compliance with his obligation to provide appropriate documentation of assessment and treatment of patients at his clinic.

Licensee agreed to accept this discipline "to avoid the time burden and expense of further proceedings and to resolve this matter before the board." Licensee also reserved the right to contest the findings in the consent agreement in any civil proceeding brought by any person who was not a party to the consent agreement.

Summary: On September 10, 2002 the New Hampshire Physical Therapy Governing Board revoked licensee's New Hampshire license to practice physical therapy due to inappropriate verbal and physical conduct directed towards two teenaged girls who were patients of the licensee. The Maine board gave full faith and credit to the New Hampshire board's findings of fact and adopted the sanctions imposed by the New Hampshire board, except for payment of a $2000 fine. The sanctions adopted by the Maine board include the immediate revocation of licensee's Maine license to practice physical therapy for 5 years.

Summary: Licensee's license to practice was suspended by the board on 3/24/98. In the 3/19/02 consent agreement, the license was reissued, on a probationary basis, upon the board's finding that licensee had completed a drug and alcohol rehabilitation program and had met the conditions for reinstatement in another state. The initial probation period of the reissued license is six months, during which time licensee must completely abstain from the use of alcohol or drugs, with the exception of substances used in accordance with a valid prescription from a physician who is aware of licensee's substance abuse history.
