consent agreement requiring him to obtain evaluation and counseling
for sexual harassment by a provider pre-approved by the board. The counseling
and evaluation which licensee did receive was based on incomplete and
misleading information provided to the counselor by the licensee and
therefore was of suspect validity and little use to the board. Additionally,
licensee failed to obtain 3 hours of continuing pharmacy education approved
by the board in sexual harassment and/or boundary issues for the years
2004-05. The board reinstated penalties that were suspended in the May
4, 2004 consent agreement. Specifically, the board suspended licensee's
license for 165 days, ordered licensee to pay a $3500 civil penalty,
and put the license on probation for 5 years. As conditions of probation,
licensee shall obtain evaluation and counseling for sexual harassment/boundary
issues by a provider pre-approved by the board, and shall obtain 3 hours
of continuing pharmacy education approved by the board in sexual harassment
and/or boundary issues every year for the duration of the probation.

Disposition: Decision and Order dated 9/13/05
Summary: Licensee failed to secure the pharmacy so as to prevent the
theft of controlled substances by employees of the pharmacy. The pharmacy
was left unattended at times; the alarm system was out of order; there
was no barrier to prevent access to prescription drugs; expired drugs
were improperly stored; the safe containing controlled drugs was left
open when the pharmacist was out of the store; and the safe's combination
was on the back of a bottle of alcohol which could be observed by unauthorized
individuals. Licensee failed to report the missing drugs to the proper
authorities when discovered in 2004.
The board placed licensee on probation for 7 months. The board ordered
the existing suspension be held in abeyance and that licensee be permitted
to practice as a pharmacist provided that he first pass the Multistate
Pharmacy Jurisprudence Examination and, following same, be under the
direct supervision of a pharmacist for at least 14 days. Licensee shall
continue his current substance abuse counseling until at least February
2006. Licensee shall receive continuing education in dispensing of drugs
and drug abuse by medical professionals and shall receive a physical
examination and a hearing test. The board issued licensee a reprimand
and ordered licensee to pay $3177.50 hearing costs. The board fined
licensee $10,700, all but $4000 of which shall be forgiven in the event
that no terms of his probation are violated and there are no further
violations of board rules and statutes during the probationary period.

Summary: Licensee admitted that he stole Tussionex (Hydrocodone in liquid
form) from the pharmacy where he worked. Tussionex is a narcotic analgesic
which can produce symptoms of sweating, depression and almost a catatonic
state. In 1992, licensee had signed a consent agreement that resulted
in the voluntary surrender of his license due to his appropriation of
Tussionex and Tylenol #3, which license was later restored. Licensee's
recent conduct violated a covenant of the 1992 consent agreement in
which licensee agreed to maintain total abstinence from use of alcohol
and any and all illicit substances including narcotics and all other
mood or mind altering substances.
Licensee appeared fatigued at work and was sweating and had difficulty
in focusing on his work. The board found that licensee's drug habit
posed an immediate threat to the public since the drug affected mental
alertness and sound judgment.
The board revoked the license, issued licensee a reprimand, imposed
a $1500 civil penalty, and ordered licensee to pay $2360.98 hearing
costs.
