Summary: Licensee was hired to replace an old steam boiler, install
an efficient heating system and hook up the living room to the new system.
Licensee left the job during December without finishing the work. The
homeowner was unable to reach licensee, and was without water for two
weeks and without heat for six weeks. Licensee avoided the board inspector
for approximately four months. When licensee met with the inspector,
the inspector gave him an order of correction and explained the violations
he had found. Licensee agreed to make the repairs, but never made repairs
or completed the heating system. Following hearing, the board found
that licensee had committed 19 violations of the board's rules and National
Fire Prevention Association codes. (See the decision for details.) Because
of the nature, number and severity of the violations, which could pose
threats to personal safety, property and the environment, as well as
licensee's failure to respond to the homeowner, the board revoked the
license, fined licensee $250 for each of the 19 violations, and fined
licensee $1500 for gross negligence, incompetence and failure to comply
with the order of correction, for a total fine of $6250.

backflow preventer not piped to the floor, and (f) thermostat wire not
directly connected to copper piping; the flexible conduit was hanging

and ordered licensee to complete a code course. The board fined licensee
$250 for each of the six violations and $500 for failure to comply with
the order of correction, for a total fine of $2000.

The furnace, which hadn't been cleaned in 12 years, exploded during
this service call. Shortly thereafter, licensee arrived and informed
the homeowners that they would need a new furnace. The homeowners purchased
a new furnace and the same apprentices arrived to prepare for its installation.
Licensee was en route to the home when he sustained car trouble. Due
to the external weather conditions and the lack of heat in the home,
he ordered the two apprentices to install the furnace, which they were
not licensed to do. The furnace was only temporarily installed due to
some missing parts and licensee testified that he returned sometime
thereafter but the homeowners wouldn't allow him back inside. The remaining
work was completed by another licensee.
The board found eight installation violations. The board issued a warning
for these violations and ordered licensee to complete a board code course.
The board also fined licensee $100 for two of the above installation
violations that licensee could have remedied before he left the home.
In addition, the board issued a warning and fined licensee $500 for
violating a board rule requiring that an apprentice oil licensee must
be under the direct supervision of a journeyman or master at all times
while altering, repairing, or installing oil burning equipment.
