BENNETT, EDISON H.

Summary: An annual survey of the nursing home supervised by licensee found widespread deficiencies that constituted no actual harm but had the potential to cause more than minimal harm. A revisit almost two months later found that two of the deficiencies in the annual survey had not been corrected, and also identified two new deficiencies: (1) Physical Restraint, and (2) Resident Assessment. The deficiencies cited in the revisit survey were corrected shortly thereafter.

Licensee failed to implement adequate procedural and operational systems at the nursing home to ensure that residents were receiving services that complied with the standards of practice for resident care. Licensee lacks an adequate understanding of his role as an administrator to provide leadership to ensure that the current standards of practice are being employed at a nursing facility.

Licensee agreed to a 2-year probation. Conditions of probation include completing continuing professional education in the areas of current CMS guidelines for nursing home administration; completing a 3 credit course in leadership from an accredited college or university; and providing the board with a written report every three months regarding the status and progress in his participation in continuing professional education and plans for future education during his term of probation. Mr. Bennett's license will remain on probationary status and subject to the terms of the consent agreement indefinitely beyond the 2-year probationary period unless and until the board, at licensee's request, votes to terminate the probation. When considering whether to terminate the probation, the board will consider the extent to which licensee has complied with the provisions of the consent agreement.

Summary: Facility failed to provide adequate medical care for a resident admitted with a decubitis ulcer on the coccyx/sacrum area. Resident was discharged eleven days after admission with a stage IV decubitus ulcer that later required multiple surgeries to correct. In addition, the resident also suffered from progressing groin blisters, and pressure sores to her ear and heel while at the facility. This complaint was an isolated incident. Licensee agreed to a reprimand.

Summary: Licensee admitted that the nursing home: (a) violated physical restraint standards with respect to a severely disabled resident who died after his head fell between the bars of his bed rails, cutting off his air supply, and (b) violated transfer and discharge requirements by refusing to accept back a resident with Alzheimer's disease and severe behavioral problems after a hospital psychiatric unit refused to admit the resident. (The resident had previously been admitted to the psychiatric unit and returned to the nursing home.)

Licensee agreed to a reprimand and to a period of probation ending on January 2, 2005.

Summary: A resident of the nursing home with Alzheimer's disease who was assessed as an elopement risk eloped on August 8, 2002 and was found dead the following morning from drowning. There were multiple failures in the management system of the nursing home, which consisted of: (a) preventive maintenance regarding safety of the physical plant; (b) lack of documentation pertaining to resident assessments and individualized plans of care; (c) lack of employee orientation and documentation of mandatory training and the lack of employee performance appraisals and evaluations; and (d) lack of operational policies.

Licensee agreed to a 6 month suspension followed by a 1-year probation. As a condition of probation, licensee agreed to complete 2 college courses in organizational management in long term care, and human resources management, respectively.

Summary: Licensee was the administrator of a nursing home. Upon inspection of the facility by DHS, 20 deficiencies, including failure to provide an environment promoting a resident's quality of life and failure to provide adequate housekeeping and maintenance services, were discovered. After three follow-up inspections several deficiencies remained uncorrected from the previous surveys and new deficiencies appeared. Licensee was issued a 90 day suspension for each violation of the board's code of ethics, totaling 360 days.
