Summary: Respondent disclosed a criminal conviction in Kentucky on his application for licensure as a massage therapist. After the application was submitted, the Office of Licensing and Registration (OLR) received notice of a Maine criminal conviction from the State Bureau of Identification which respondent had not disclosed on his application. OLR requested respondent to provide a copy of the judgment of the Kentucky conviction, to explain why he made no mention of the Maine conviction on his license application, and to submit a letter explaining the circumstances of the Maine conviction. Respondent received this request but did not respond, whereupon OLR preliminarily denied the application.

Respondent appealed the preliminary denial. His letter of appeal stated his assumption that his Maine conviction would be revealed by OLR's criminal history search. At hearing of this matter, respondent produced the documents that had been requested by the board, stating that he was "too busy" in his employment to provide them earlier. During cross-examination, respondent admitted to a third criminal conviction that in all likelihood would not have been otherwise revealed by respondent.

OLR held that respondent's failure to disclose the Maine conviction, failure to provide the documents requested by OLR in a timely manner, and attempt to conceal the third conviction constituted fraud or deceit in attempting to obtain a license. OLR also concluded that respondent had failed to carry his burden of demonstrating that he had been sufficiently rehabilitated to warrant the public trust. OLR affirmed the preliminary denial of licensure and denied respondent's appeal. OLR also imposed a $250 civil penalty.

Summary: On December 11, 2001, respondent sold to the complainant a package of 12 massage therapy appointments. Complainant had those appointments with licensee on December 11, 14 and 18, 2001, as well as January 2 and 4, 2002. When the package of appointments was sold, respondent was working in the South Portland area, but she relocated to Falmouth. Licensee agreed to continue seeing complainant in South Portland, however, this required her to relocate her equipment for the appointment. Licensee and complainant disagree as to whether they started the appointments on time. Licensee says that she got there ahead of time and was ready to start on time. Complainant indicates that licensee would arrive on time, but needed to set up and, therefore, the appointment would start late.

The last attempted appointment was January 6, 2002, at which time licensee did not show fro the appointment in a timely manner due to the fact that her car had been "booted." After the no-show for the January 6, 2002 appointment, complainant discontinued her sessions. She asked for a refund of the remaining sessions and asked numerous times before the money was finally paid back on approximately March 28, 2002.

Licensee accepted a warning that this engagement was not conducted in a fully professional manner.

PAYNE, JAMES B.

Licensee also agreed to a 90 day probation, during which time he agreed to meet for 6 one-hour face-to-face counseling sessions no less than 1 week apart with a psychiatrist, psychologist, licensed clinical professional counselor or licensed clinical social worker to investigate why licensee acted as he did in connection with this violation. If the counseling is completed before the end of the probationary period, the probation may be terminated at that time.
