Summary: The board received a complaint regarding a modular home that had been manufactured by New Era, sold by Camelot, and installed by Ambrose. After one day of hearing, the parties agreed to resolve the matter by consent agreement. Each licensee signed a separate consent agreement. The three consent agreements each contained the following admissions:

1 .In July 2005, one modular unit of the home containing plumbing work sustained significant, structural, in-transit damage to its open joist floor trusses.
2. In July 2005, New Era engaged in incompetent practice when it approved repairs of the damaged floor trusses without first obtaining a required approved plan from a third party inspection agency.
3. In July 2005, Camelot engaged in incompetent practice when it undertook and completed the unapproved floor truss repairs, which were not structurally sound and did not provide satisfactory plumbing.
4. In July 2005, Ambrose engaged in incompetent practice when it installed the home, specifically the damaged unit that had been repaired in a structurally unsound way with unsatisfactory plumbing.
5. In January 2006, New Era engaged in incompetent practice when, for a second time, it approved repairs of the damaged floor trusses without first obtaining a required approved plan from a third party inspection agency. Specifically, New Era attempted to use an unacceptable method of attaching new open joists to the decking; that is, it attempted to use glue alone without screwing down through the decking and into the open joists.
6. New Era ultimately provided for structurally sound on-site repairs to the floor trusses in accordance with a plan approved by a third party inspection agency, namely the damaged floor trusses and unapproved repairs were removed and replaced with approved, new, properly attached open joist floor trusses, and the unsatisfactory plumbing was removed and replaced.
7. New Era improperly set fasteners on a kitchen cabinet, allowing the fasteners to visibly and unacceptably protrude from the cabinet in violation of the home's statutory manufacturer warranty.
8. Camelot improperly installed carpet, allowing seams to be unacceptably visible in violation of the home's statutory installer warranty.

9.Camelot improperly framed the home's gable ends in the attic, failing to provide proper support in violation of the home's statutory installer warranty.

New Era and Camelot agreed to jointly and severally make ten specific repairs, replacements and remedial work items as specifically described in the consent agreements. New Era and Camelot each agreed to submit a policy for board approval addressing the repair and replacement of modular units damaged in transit.

New Era, Camelot and Ambrose agreed to jointly and severally pay hearing costs not to exceed a total amount of $2500. New Era agreed that its engineering manager and service manager will complete the board's training course. Camelot agreed that its president and service will complete the board's training course. Ambrose agreed to complete the board's training course.

Camelot agreed to ten unannounced installation inspections by board staff during the 6-month period following execution of the consent agreement, with possible participation by a third party inspector at Camelot's expense. Camelot agreed to pay an additional $1500 to cover the board's costs of these inspections.

New Era and Camelot each agreed to a schedule of escalating civil penalties in the event that the consent agreements are not complied with.

Ambrose agreed to a $1000 civil penalty.

AUGUST 24, 2006 UPDATE: The board approved an amendment to the consent agreement involving Camelot Homes only. In lieu of replacing all first floor carpet and linoleum, Camelot agreed to forgive money owed to it by the consumer.

Summary: This proceeding was a license denial hearing. On applications for mechanic and installer licenses, licensee answered the question of whether he had ever been convicted of a crime by responding, "Yes, 1995 or 1996, not sure." Licensee's criminal history record subsequently revealed convictions in: 1971 for robbery and grand larceny; 1975 for disorderly conduct; 1977 for simple assault; 1986 for criminal mischief; 1997 for possession of a firearm by a felon; 1997 for driving under the influence of alcohol.

At hearing in this matter, licensee explained the circumstances of his early convictions and testified that he has not been convicted of any criminal conduct since his OUI conviction in April 1997. He displayed some understanding that he should have more truthfully filled out his applications for licensure, but thought that the State Bureau of Identification history would provide the board with his full record Additionally, he testified that he has established a business of transporting mobile homes and supplied the board with three references in that regard. Currently, he desires to expand that enterprise by being licensed as an installer and mechanic.

The board believed that a reasonable person would not forget having committed these criminal offenses. The board granted the licensees requested, but put licensee on probation until May 8, 2007. The board also fined licensee $250 (which licensee immediately paid after the hearing).

Summary: Homeowner complained that during the summer of 2005 granules washed off the shingles of the roof of her manufactured home in sufficient quantity to clog the rain gutter of her home. Neither Sargent's, Fleetwood, or the shingle manufacturer acknowledged any defect in the shingles. An independent contractor hired by the homeowner gave the opinion that the shingles would not last through the upcoming winter and would allow leakage into her home if the roof was not replaced, whereupon the homeowner hired the independent contractor to replace the roof. Board staff inspected the home and samples of the original shingles that had been removed from the roof. Staff observed no evidence of homeowner neglect or misuse. Staff concluded that the original shingles showed unusual wear and loss of granules from exposed portions, that the shingles did not perform as intended, and that the homeowner was justified in re-shingling the entire roof.

Licensees admitted that they violated the implied warranty of merchantability, and agreed to reimburse the homeowner $4200 as the reasonable cost of roof replacement. Licensees also agreed to pay costs associated with scheduling the hearing in this matter

"The Board reasoned that Fox Hill was clearly derelict in the amount of time that elapsed before major problems were satisfactorily addressed if, indeed, they were at all. The design of the second floor demonstrated incompetence in that Fox Hill did not further communicate this design to the manufacturer in a meaningful manner and the homeowner was entitled to rely on the representations depicted by the design. Additionally, the roof may have collapsed had the homeowners followed the advice of Fox Hill and moved the upstairs wall. The trusses should have been nailed to the rafters in a timely manner and the floor hump corrected."

Summary: Consumers purchased a modular cape style home from Modular that was manufactured by Ritz-Craft. Modular Enterprise installed the home on the consumers' lot. Following the consumers' initial contact with the board, the board inspector found 20 violations upon initial inspection. The respondents failed to fully remedy these violations for more than a year, whereupon the board filed a complaint against them to enforce their warranty obligations under 10 MRSA §1404, which provides: "[A] statutory warranty is hereby established under which both the manufacturer and the dealer certify that to the best of their knowledge, the new mobile home is free from any substantial defects in materials and workmanship."

The board held:

"The Board is of the opinion that the vast number of the twenty noted violations is attributable to Modular since Modular had displayed the home for more than one year and assumedly would not have accepted the home in the above condition. The Board further finds and concludes that the Respondents have taken an excessive amount of time to attempt to repair the deficiencies found in the Morneault's home. Therefore, considering the joint and several liability subsections quoted above, the Board finds both Respondents responsible for the violations contained in inspector Oullette's reports."

The board suspended Modular's license for 90 days, issued Modular a $4500 civil penalty and ordered Modular to perform all but 3 of the necessary repairs. The board ordered Ritz-Craft to perform 3 of the necessary repairs, and ordered Ritz-Craft to pay $500 for each of these repairs that is not made within the time established by the board. The board also ordered Ritz-Craft to pay ½ the hearing costs in this matter, in the amount of $642.50.
