Summary: Licensee submitted reports of 90 elevator inspections in a 3-day period. The Chief Elevator Inspector performed random re-inspections of 9 of these elevators and found that licensee failed to report multiple conditions in violation of the board's laws and rules with respect to 8 of the 9 re-inspected elevators. Licensee admitted that he failed to report the violations found by the Chief Elevator Inspector.
Licensee's license expired during the investigation of the complaint, and licensee has not applied for renewal. Licensee agreed that he will never apply for any type of licensure at any level with the board at any time in the future and, if he should so apply, the board is not required to entertain his application.

Licensee admitted that it failed to make corrections necessary to render the elevators in compliance with the governing code, that it failed to take the elevators out of operation when they failed to qualify for inspection certificates, and that it failed to comply with the chief inspector's orders to either remedy the deficiencies or take the elevators out of operation. Licensee agreed to a reprimand and agreed to make all necessary corrections. Licensee also agreed to a $4000 civil penalty, all but $2000 of which is stayed.

Licensee, whose license expired on December 31, 2002, also agreed that: (a) if he ever applies to renew his license, he must first present proof of satisfactory completion of an elevator safety code training course, and (b) if the application is approved, the license will be subject to a period of probation. During probation, licensee will review in person with the board inspector or his designee the results of the first 10 elevator inspections that he performs. The probationary status of the license will continue until the board inspector determines that licensee's inspection performance is satisfactory.

The board ordered licensee to pay $982.50 hearing costs, and directed that licensee not receive an inspection certificate until he has complied with the Board Order.

BELLIEVEAU, ROBERT

Summary: During the repair or alteration of a warehouse freight elevator, licensee: (a) replaced only 1 of the elevator's 4 hoist ropes, (b) after installing an interlock, failed to assure that there was no more than a ¾ inch opening between the upper and lower portions of the vertically-sliding door panels when the door was in the closed position, and (c) installed a controller that was 20-25 inches from a steel beam capable of conducting electricity, whereas the governing code required a minimum clearance of 36 inches from the front of the controller to any obstacle. These violations were willful and involved serious life and safety issues. Licensee attempted through his testimony at hearing to deceive the board about both his conduct and his intentions at the time of the violations. The board revoked the license and barred licensee from re-applying for licensure for 2 years.
