Summary: Complainant testified that she desired to rent a booth from
licensee's salon. In her August 2003 application for a booth license,
complainant, who had been working with licensee as a cosmetologist,
listed licensee as the owner of the establishment. Licensee, unbeknownst
to complainant, was not licensed as an establishment to operate the
salon. Licensee subsequently requested complainant to white out her
name and write in that of the former owner who in July 2003 had sold
the salon to licensee. Complainant then observed licensee forge the
name of the former owner to the application and falsely stated that
she could operate the salon pursuant to the former owner's license.
Licensee then requested that complainant submit the application to the
board which complainant refused to do.
Licensee applied for an establishment license on August 2, 2004. She
listed the date of change of ownership as July 2, 2004 which, if true,
would have allowed her to operate the salon under the former owner's
license until August 2, 2004. Licensee was granted a license but the
board clerk later discovered that the establishment had been inspected
in March 2004 and the record revealed that a change of ownership had
occurred as of at least that date. Licensee later signed a consent agreement
in December 2004 to resolve the violation of operating without a license
for approximately eleven months. As regards the separate allegation
in this hearing that she misrepresented the date when she purchased
her establishment, licensee in her response to the complaint stated
that she had "made a mistake."
The board concluded that licensee forged the signature of the former
owner on the complainant's booth application and intentionally misrepresented
the purchase date of the establishment in her application for licensure.
The board reprimanded licensee, fined licensee $3000, and ordered licensee
to pay $470.50 hearing costs.

Summary: On January 6, 2004, a board inspector performed an initial
inspection of Hairitage Salon in Ellsworth, where licensee was renting
a booth in order to practice her profession. The inspector informed
the licensee, a licensed cosmetologist, that she was in violation of
board statutes and rules since she had not applied for her booth license
at this location and had not posted her cosmetology license for public
viewing. The inspector gave the licensee until January 20, 2004 to correct
these violations. On May 20, 2004, the inspector revisited the salon
and observed that licensee had not posted her cosmetology license in
view of the public and neither had she applied for her booth license.
The licensee was ordered to correct these violations by June 7, 2004.
On August 5, 2004, the inspector performed her third inspection of the
salon and found the same violations regarding the licensee. The board
issued licensee a reprimand, fined licensee $600 for her failure to
obtain a booth license, fined licensee $200 for her failure to post
either license in view of the public, and ordered licensee to pay $282.50
hearing costs.

Summary: Licensee Bennett obtained an occupancy permit from the City
of Biddeford in October 2000 by falsely representing to the city that
his shop would be an open display retail store for the sale of professional
skin care products, with no cubicles or changing rooms. Based in part
on this occupancy permit, the board issued an establishment license
for the premises. In actuality, interior walls had been erected, forming
small rooms. Licensee Bennett operated the establishment for 14 months,
from October 2000 until December 2001. Because the establishment license
was obtained by fraud, the license was invalid and licensee Bennett
operated the establishment without a valid license for this 14-month
period. The board issued licensee Bennett a reprimand and fined him
$500 for each month of unlicensed operation, for a total fine of $7000.
The board also ordered licensee Bennett to pay $600 hearing costs.

would not provide complainant with an Affidavit of Training unless licensee
made up the missing hours at a cost of over $500.
Without admitting or denying any of the allegations of the complaint,
licensee agreed to provide complainant with the opportunity to make
up any hours necessary to qualify for her student affidavit at no cost
beyond the original contract price no later than 30 days of the execution
of the consent agreement and to notify the board in writing when complainant
obtains her student affidavit. In addition, licensee agreed to provide
