In his response to the complaint, licensee maintained that any breaches of confidentiality he may have committed were unintentional as he believed that the client had provided the appropriate release and that he was not the custodian of the client's file. Licensee admitted, however, that it is the alcohol and drug counselor's responsibility to ensure that the appropriate release exists before communicating confidential client information to third parties.
Licensee admitted that the board could find by a preponderance of the evidence that licensee breached the client's confidentiality by revealing confidential client information to a third party without a valid release. Licensee agreed to a reprimand and a $250 civil penalty. Licensee also agreed to a 3-month suspension of his clinical supervisor certification.

Summary: Licensee disclosed confidential information concerning a former client who had filed a complaint against licensee to a probation officer of the client. Although a first release executed by the former client did allow licensee to contact the client's probation officer, that release had expired and a second release still in effect at the time of the contact did not authorize the contact. The board rejected licensee's contention that concerns for her safety justified the unauthorized contact. The board held:
"Once the [first] release expired, Ms. Litchfield could not legally make any communication or commit any act to acknowledge T's existence unless she had a reasonable belief that he posed an imminent danger to himself or others. Even then, the appropriate action would have been to contact the police, not his probation officer. The Board disagreed with Jean Litchfield's interpretation of the tone of the response letter and did not find that she had a reasonable belief that she was in imminent danger from T which would have justified her contacting an appropriate public authority. The Board further expressed its agreement with Timothy M. McBrady's testimony that a parole officer is in a position of power over a parolee and that undue anxiety may be expected to result from any contact with a parole officer by a third party, much less one made after further communication was not authorized by the client."
The board reprimanded licensee, fined licensee $500, and ordered licensee to complete face-to-face supervision with her previous supervisor for one hour per month for one year specific to issues involving confidentiality.

Licensee and his former employing agency both notified the board that licensee had entered into a professional relationship with a minor child of personal friends of the licensee; that licensee failed to report an allegation of abuse made by that minor child against his father; and that licensee engaged in a personal romantic relationship with the mother of the minor child after his professional relationship with the minor child ended. Licensee admitted that he committed gross negligence, incompetence or misconduct in the performance of alcohol and drug counseling services by entering into a professional counseling relationship with the child of personal friends; failing to report the allegation of abuse made by the child against his father to the appropriate parties as mandated by state law; and engaging in a personal romantic relationship with the mother of the minor child. Licensee admitted that in the course of this review she submitted two fraudulent documents, represented that a member of her staff held an alcohol and drug counselor registration when he was not licensed or registered with the board, and attempted to conceal the fact that she was operating two unlicensed agency locations. Finally, licensee admitted that she was not forthright with agency clients and staff regarding the likelihood that the agency would not be licensed and, therefore, not be permitted to continue to offer counseling services.
Licensee agreed to a reprimand and agreed to surrender the license for two years. Licensee agreed that should she become relicensed following completion of the suspension, she will be put on probation for a minimum period of three years, during which time her practice will be subject to disciplinary supervision. Such supervision will consist of face-to-face individual sessions one hour in duration with an alcohol and drug counselor every two weeks The purpose of supervision is to provide instruction and direction with respect to professional ethics generally and specifically with respect to the legal and ethical issues raised by the complaint.

The seven unlicensed employees all worked as substance abuse counselors under licensee's supervision. (The unlicensed counselors eventually applied for, and received licenses from, the board.) The board issued licensee a reprimand, imposed a $1750 civil penalty ($250 for each of the seven violations), and ordered licensee to pay $415.50 hearing costs. The board also ordered licensee to arrange for 30 hours of supervision and 30 hours of continuing education over a period of 18 months. Summary: Licensee was registered as an alcohol and drug counselor from April 27, 2001 until November 30, 2001, when her registration expired. Licensee did not submit proof of the 20 required hours of continuing education (prorated) 90 days prior to expiration of the 2001 registration as required by board rule, or at any time prior to expiration of the registration. On March 11, 2002, licensee applied to renew her registration, but did not include any proof of the continuing education required for renewal. Licensee deliberately waited 90 days after the expiration of her license to submit her renewal application. On March 27, 2002, licensee submitted documentation of 36 hours of continuing education, only 12 of which were obtained during the time she held her registration. On June 7, 2002 the board preliminarily denied licensee's renewal application, and licensee appealed.
At hearing, licensee contended that her 2001 registration lapsed 90 days after the November 30, 2001 expiration date of the credential; that her March 11, 2002 application was consequently a new application and not a renewal application; and that no continuing education was required to qualify an applicant for initial licensure. The board rejected this line of argument, and held:
Pursuant to 32 M.R.S.A. §6219, "[a]ny person who submits an application for renewal more than 90 days after the license renewal date is subject to all requirements governing new applicants under this chapter, except that the Board may…waive examination if that renewal application is made within 2 years from the date of that expiration…" Accordingly, the Legislature intended that all applications made within two years of the date of the expiration of a license or registration are to be considered renewals subject to the requirements governing new applicants as well as the professional responsibilities which pertain to the period during which the license or registration is valid. Delaying submission of the application does not alleviate the licensee or registrant from the responsibilities of the period during which she held a registration or license with the Board. It may, however, create additional obligations on the part of the licensee or registrant in order to be eligible for renewal such as the payment of late fees and the re-taking of examinations if required for the license or registration. In this case, Ms. Samol was not only subject to the continuing education requirements for the period of time during which she held a registration but also to any additional requirements for eligibility for new applicants."
The board upheld the June 7, 2002 preliminary denial. The board also voted to issue licensee a registration contingent upon her entering a consent agreement in which she acknowledges that she did not meet her continuing education requirements for her 2001 renewal; accepts a formal warning from the Board; and provides documentation of 5.0 continuing education units [i.e., 50 hours] which she must obtain and submit to the board between the time that she enters into the consent agreement and 90 days before the 2003 renewal expiration date.

When licensee re-applied for licensure she failed to submit documentation of timely completion of continuing education and failed to submit documentation required by the October 11, 2000 consent agreement. Following initial denial of license renewal, the board issued licensee a license contingent upon her paying a $100 civil penalty for failure to timely submit proof of continuing education and a $200 civil penalty for her failure to comply with the terms of the consent agreement.
