Department of Professional and Financial Regulation Fines Maine Auctioneer, Denies License for Multiple Law Violations and Cautions the Public Against Dealing with Unlicensed Auctioneers

Commissioner Anne L. Head of Maine’s Department of Professional and Financial Regulation announced Thursday that the Board of Licensing of Auctioneers has voted unanimously to deny a license renewal to Angela Nevells of Blue Hill, to impose fines totaling $12,500 and to seek relief for the victims of Ms. Nevells’ multiple violations of law. Commissioner Head also urged the public to refrain from engaging Ms. Nevells or other unlicensed individuals in auctioneering services.

In a formal Decision and Order, the Board found that Ms. Nevells, who possesses a Blue Hill mailing address and operates Coastal Auctions in Trenton, was found to have violated numerous Maine laws. Following a June 5th hearing and subsequent deliberations, the Board concluded that serious violations had occurred in two separate cases, including:

-- Two cases of violating 32 M.R.S.A. 298: “failure to have a written contract with the consigner”;

-- Two cases of violating 32 M.R.S.A. 291-A (1): “failing to remit money”;

-- Two cases of violating 32 M.R.S.A. 291-A (1): “failing to account for property”;

-- Two cases of violating 10 M.R.S.A. 8003(5-A)(A)(2): “any gross negligence, incompetence, misconduct or violation of applicable code of ethics or standard of practice”; and

-- One case of violating 10 M.R.S.A. 8003(5-A) (A)(1): “the practice of fraud, deceit or misrepresentation”.

Ms. Nevells has advertised auctions for August 18th and August 25th in Trenton. Those auctions cannot be legally conducted by Ms. Nevells, and the public is cautioned against utilizing the auctioneering services of Ms. Nevells or other unlicensed auctioneers.
