By order of the Superintendent, the existing deadline for the filing of expert reports is today, March 2, 2000. Maine Medical Association filed a document today entitled Maine Medical Association’s Request for Enlargement of Time to File Expert Reports and Designate Issues. The filing explains that because MMA has only just received, or is still waiting to receive, certain documents requested during discovery, MMA wishes to reserve its right to: (1) designate additional experts; (2) submit expert reports; and (3) to designate additional issues in the event that the additional documents warrant the introduction of an expert report and/or the exploration of additional issues at the hearing.

Based on its review of the documents to date, MMA does not anticipate that it will seek to submit an expert report for use at the hearing. MMA has, however, engaged the consulting firm, Reden & Anders, Ltd., 60 South Sixth Street, Suite 3430, Minneapolis, MN 55402, to assist it in analyzing the proposed transaction. To date, MMA anticipates that Jay P. Boekhoff, F.S.A., M.A.A.A. and Randall P. Herman, F.S.A., M.A.A.A. of Reden & Anders, Ltd. whose biographical information is attached to this filing, will provide expert testimony related to the following three issues:

  • Whether the Anthem purchase of BCBSME is likely to result in lower administration costs, risk charges, contingency fees, and other expense components of the proposed rates.
  • Whether BCBSME can continue to operate successfully in the current Maine marketplace without acquisition by Anthem
  • Whether Anthem will provide appropriate and adequate support to providers engaged in managed care contracts with Anthem. Most particularly, whether Anthem will provide appropriate and adequate support in cases in which providers are providing services under risk-sharing contracts.

In addition, as indicated in Maine Medical Association’s Request for Enlargement of Time to File Expert Reports and Designate Issues, MMA wishes to reserve the right designate additional experts, and to amend the issues and the scope of expert testimony once MMA and Reden & Anders have reviewed the documents it has just received, and those it expects to receive, within the next few days.
