BCBSME’S MEMORANDUM IN SUPPORT OF OBJECTIONS TO CONSUMER INTERVENORS’ DISCOVERY REQUESTS

Applicant Anthem Insurance Companies has filed a memorandum in support of its objections to Consumer Intervenors’ First Discovery Request. Although the rules governing discovery do not require the filing of such a memorandum, BCBSME agrees that Anthem’s memorandum appropriately underscores some of the unusual burden that Intervenors’ request has imposed on the Applicants.

BCBSME will not repeat the points made in Anthem’s memorandum. But it bears emphasizing that in this case the Superintendent is not situated as a passive adjudicator finding facts only from the evidence the that Applicants and private intervenor/opponents have discovered and produced. In this case, the Superintendent has used his staff and hired outside consultants to generate information that the Bureau regards as relevant to the proceedings. In addition, the Attorney General, working with his consultants, has served three separate sets of discovery requests on the Applicants.

With both the Superintendent’s staff and the Attorney General having assiduously pursued the development of relevant information through the discovery process, something more than a tenuous relation to the issues set forth in the Superintendent’s notice should be present before the Applicants are sent on a far ranging detour in search of documentary materials and other extraneous data.
