Re: Application of Associated Hospital Service of Maine, d/b/a Blue Cross and Blue Shield of Maine, to Convert to a Stock Insurer and Voluntarily Liquidate and Dissolve and Application of Anthem Health Plan of Maine, Inc., to Acquire the Assets of Associated Hospital Service of Maine, d/b/a Blue Cross and Blue Shield of Maine, and Related Transactions, Consolidated Docket INS-99-14

Dear Superintendent Iuppa:

Please accept this letter as the response of the Attorney General to the applications to intervene submitted by Maine Health Alliance; Central Maine Health Care Corporation; Thomas D. Haywood, Maroulla S. Gleaton and the Maine Medical Association; the Maine People’s Alliance; Consumers for Affordable Health Care Coalition; and the Maine Council of Senior Citizens.

The Attorney General has no objection to the application to intervene filed by the Maine Health Alliance, Central Maine Health Care Corporation; Thomas D. Haywood, Maroulla S. Gleaton and the Maine Medical Association; and Consumers for Affordable Health Care Coalition.

With regard to the application for intervention filed by the Maine People’s Alliance and the Maine Council of Senior Citizens, the Attorney General notes that Consumers for Affordable Health Care Coalition, in support of its application to intervene, stated that it represents the interests of its members. The members of the Coalition include the Maine Council of Senior Citizens and the Maine People’s Alliance. Under these circumstances, it may be sufficient if the application of the Coalition to intervene is granted and that the Maine Council of Senior Citizens and the Maine People’s Alliance participate in the proceeding through the Coalition. If the Superintendent decides that it is appropriate to grant intervenor status to the Maine Council of Senior Citizens and the Maine People’s Alliance, the Attorney General would request that the Maine Council of Senior Citizens, the Maine People’s Alliance and the Consumers for Affordable Health Care Coalition be required to coordinate their discovery efforts and their presentation of evidence and argument.

Thank you for your attention to this matter.

Sincerely,

WILLIAM H. LAUBENSTEIN, III
