Dear Superintendent Iuppa:
This is with regard to the order establishing deadline for discovery related to the qualifications and independence of Houlihan, Lokey, Howard and Zukin. The order directed the parties to notify the Superintendent and all parties of the name, professional affiliations and summary of testimony for each witness no later than 3:00 p.m. on January 21, 2000. The Attorney General, by letter dated January 20, 2000, requested that the time within which to notify the Superintendent of the nature of any evidence to be presented be extended to February 4, 2000. This request was granted.
This is to notify you that the Attorney General, after reviewing materials filed with the Superintendent by Blue Cross Blue Shield of Maine and materials submitted in response to the Attorney Generals Second Discovery Request, has decided that he will not be presenting any evidence at the hearing scheduled for February 8, 2000 and will not be presenting any witnesses.
