BCBSME does not object to the Attorney Generals request for a limited extension of its deadline to provide notice of the nature of the evidence, if any, that the Attorney General intends to present at the pre-hearing conference on the independence and experience of Houlihan Lokey. The Attorney Generals request is to extend the time for the Attorney General to provide the required notice until February 4, 2000, and to re-set the pre-hearing conference on this issue matter to February 8, 2000. BCBSMEs decision not to object to this request position is based on the understanding that 1) the postponement of the pre-hearing conference will not result in a delay in the current plenary evidentiary hearing schedule in this matter; and 2) that since no parties other than the Applicants and the Attorney General have filed either a notice of expected evidence to be presented at the pre-hearing conference concerning independence and experience of Houlihan Lokey, or a request for extension of time to provide such notice, the Superintendent will only consider the evidence, if any, to be offered by the Applicants and the Attorney General on these issues at the re-scheduled pre-hearing conference. If BCBSMEs understandings in this regard are incorrect, BCBSME requests that it be so advised, so that it will have the opportunity to re-consider its decision not to object to the Attorney Generals request.
