In response to the Superintendent’s Order Establishing Deadlines for Discovery Related to Qualifications of Houlihan Lokey Howard & Zukin Financial Advisors, Inc., BCBSME submits for the record the following:

  1. BCBSME’s Responses to the Superintendent’s First Discovery Request, ¶’s 1 and 2 ( B00076 – 80 attached);
  2. Letter Agreement between BCBSME and Houlihan Lokey Howard & Zukin Financial Advisors, Inc (B00081 – 86 attached);
  3. Houlihan Lokey Howard & Zukin Financial Advisors, Inc.’s presentation to BCBSME, August 9, 1999 (produced in response to the Superintendent’s Second Discovery Request as B04098 – 04136 (attached)).; and
  4. BCBSME response to the Attorney General’s Second Discovery Request, ¶‘s 4 and 5.

Unless otherwise advised, BCBSME intends to rely on these written submissions as establishing compliance with the statutory requirements of 24 M.R.S.A. § 2301(9-D)(I)(2). Were witness testimony on these points deemed necessary, the above responses and incorporated documents fairly summarize what would be the testimony of Houlihan Lokey Howard & Zukin Financial Advisors, Inc. on these issues.
