October 29 Prehearing conference and proposed procedural order

Dear Superintendent Iuppa:

In accordance with the Notice of Pending Proceeding and Prehearing Conference, dated September 24, 1999, Applicants herein file an original and ten paper copies of their proposed Motion for Procedural Order, with draft Order attached. Also enclosed are three diskette copies of the Motion and proposed Order, in Microsoft Word, two read-only, one not.

The purpose of the Motion, as it reflects, is to ensure efficiency and clarity of procedures.

Please note that certain procedural points are purposefully left blank in the Proposed Order, e.g., §V, listing the Bureau’s Staff Advisors. Applicants look to the Bureau for the appropriate insertions to replace these blanks.

Finally, Applicants respectfully request that some brief portion of time on October 29 be set aside to explain or otherwise clarify certain questions they have as to some aspects of the Protective Order entered by the Superintendent on or about October 18, 1999. Specifically, Applicants seek clarification as to the circumstances under which unrepresented intervenors may have access to confidential documents.

Thank you for your attention to these matters. We look forward to discussing them and the items listed in the September 24 Notice of Hearing at the prehearing conference on October 29.
