Notice of Second Election Period for Maine Continuation Coverage [Mini-COBRA]

 

Maine Public Law 2007, Chapter 244, Part J, establishes a second election period for certain individuals.  This law was effective on June 3, 2009.  The law requires carriers to provide notice to affected individuals in a form specified by the Superintendent of Insurance.  Carriers are hereby instructed to use a modification of the federal second election period notice, found at http://www.dol.gov/ebsa/COBRAextendedelectionperiodnotice.doc.  Carriers should be careful to modify the form as necessary to reflect Maine law.  For example, where the federal form refers to “a loss of coverage at some time from September 1, 2008 through February 16, 2009,” the appropriate time period under the Maine law is September 1, 2008 through July 3, 2009.
