By Notice of Pending Proceeding and Hearing issued in the above-captioned proceeding on July 19, 2007, Acting Superintendent of Insurance Eric A. Cioppa identified possible hearing dates ranging between September 5, 2007, and October 3, 2007,1 depending upon the date when the Dirigo Board files its determination of aggregate measurable cost savings. The Dirigo Board made its filing with the Superintendent on August 6, 2007. Pursuant to 24-A M.R.S.A § 6913(1)(C), “no later than 6 weeks following the receipt of the board’s determination, the superintendent shall issue an order approving, in whole or in part, or disapproving” the Dirigo filing. Accordingly, the Superintendent’s determination must be made on or before September 17, 2007. Given the timing of the Dirigo filing, the only previously identified possible hearing date that could accommodate the statutory 6-week determination by the Superintendent is September 5, 2007. If this date were to be used for the hearing, an interested person would have at most four weeks to develop their case before the Superintendent.2 The Superintendent desires to preserve to the greatest extent possible the period of time a party has to develop their case. By reason of the foregoing, for cause shown and in the exercise of his discretion the Superintendent hereby modifies the previously proposed schedule and establishes the actual hearing date as September 10, 2007, beginning at 9:00 a.m. in Room 209 of the Burton M. Cross Building, 111 Sewall Street, Augusta, Maine.

Moreover, the deadline for intervention is August 10, 2007. Therefore, by the time interested persons may be granted party status, their period of time to put on a case would be approximately 3½ weeks if the September 5, 2007, possible hearing date were used.
