Harleysville Worcester Insurance Company Held July 24, 2012 – Docket No. INS-12-2061 The named insured requested a hearing to contest the nonrenewal of her dwelling fire policy for several stated conditions. The insured demonstrated that two of the four conditions had been rectified. The company maintained that the conditions render the property uninsurable. Held: For the insured. 24-A M.R.S. § 3051 requires the company to demonstrate that its reason for nonrenewal is in good faith and related to the insurability. The policy in question provides coverage for only basic named perils, and the company failed to explain how deteriorated siding and eaves with peeling paint impact those perils.
