The named insured requested a hearing to contest the nonrenewal of homeowners insurance due to auto repairs for others being conducted in a garage attached to the home. The company demonstrated that repair of a vehicle not owned by the insured had resulted in a fire loss.
Held: For the company. 24-A M.R.S.A. § 3051 allows nonrenewal of a policy for a good faith reason that is related to the insurability of the property. The company established that vehicle repairs are conducted regularly on the premises, and that a recent repair resulted in a fire damage loss. As this activity increases the risk of loss insured under the policy, the company’s stated reason meets the standard for nonrenewal of the policy.
