Nicholas Dow v. Allstate Insurance Company

The named insured requested a hearing to contest the nonrenewal of his homeowners policy for either having no responding fire department or the existing fire department service is inadequate, based upon an ISO Class 10. The evidence showed that the community has not been evaluated by ISO, although its fire department was established in 1979. Allstate failed to establish that the existing fire department service is inadequate.
Held: For the insured. The Maine Property Insurance Cancellation Control Act allows nonrenewal for a reason that is in good faith and related to the insurability of the property. Although Allstate had relied upon an ISO ranking of 10 for its nonrenewal reason, as the community has never been evaluated the ranking is meaningless. Accordingly, Allstate failed to prove its stated reason for nonrenewal.
