State Farm Fire & Casualty Insurance Company Held January 5, 2011 - Docket No. INS-10-2118 The insured requested a hearing to contest the company’s cancellation of the homeowners policy for the named insured’s criminal convictions, and also for failure to disclose material facts in response to questions in the application for insurance, i.e. six claims made in the prior three years, and the presence of a dog in the household with a previous history of aggressive behavior. The record was held open until January 12, and then until January 18, as requested by the policyholders’ attorney, for documents supporting the policyholders’ testimony to be provided. On January 26, the Bureau received written notification from the attorney that the policyholders no longer wished to pursue the hearing matter as they had obtained other insurance and chose not to provide the supporting documentation. Accordingly, the matter was dismissed.
