York Insurance Company of Maine Held December 16, 2010 - Docket No. INS-10-2113 The named insured requested a hearing to contest the nonrenewal of a dwelling fire policy for cited property conditions. The company demonstrated that two conditions exist that increase the potential for a liability loss, and another increases the potential for damage resulting from fire. Held: For the company. 24-A M.R.S.A. § 3051 allows nonrenewal for a reason that is in good faith and related to the insurability of the property. As the cited conditions affect perils covered by the policy, and the company has met statutory notice requirements, the nonrenewal is permitted under Maine law.
