Anne Harrison v. MMG Insurance Company

Held December 8, 2010 - Docket No. INS-10-2109
Decision Issued: December 20, 2010

The policyholder requested a hearing regarding the intended nonrenewal of an automobile insurance policy. The company’s notice identified two accidents as the reason for the nonrenewal.

Held: For the insurer. The Maine Automobile Cancellation Control Act permits nonrenewal of a policy when the named insured or customary operator is involved in two or more accidents while driving a motor vehicle insured under the policy, if the accidents occur within the 36 months preceding the annual anniversary date of the policy and each exceeds $1,000 in damages. None of the statutory exceptions applied to the stated accidents, and the company demonstrated that nonrenewal and notice requirements were met.
