Robert & Patricia Lad v. NGM Insurance Company

The named insured requested a hearing to contest the cancellation of an automobile policy because of a driver’s license suspension. The suspension cited by the company does not qualify for cancellation grounds.

Held: For the insured. The Maine Automobile Insurance Cancellation Control Act in 24-A M.R.S.A. § 2914(4) allows cancellation for suspension of driver’s license that meets the requirements set forth. The first requirement is that the suspension must have occurred during the current policy term, or within 180 days of its effective date if a renewal. The suspension cited by NGM did not fall within this time frame, therefore the cancellation is not permitted.
