The named insured requested a hearing to contest the nonrenewal of homeowners insurance for failure to comply with recommendations. The company established that reasonable recommendations were issued to the insured in September 2010, and that the insured had not complied with all of the loss control recommendations that were issued.

Held: For the company. 24-A M.R.S.A. § 3049(10) allows cancellation for failure to comply with reasonable loss recommendations within 90 days after notice of the recommendations from the insurer. As the company demonstrated its compliance with all applicable statutory requirements, and that one or more reasonable recommendations remains unaddressed, the cancellation action is permitted.
