Charles Sinclair v. Patrons Oxford Insurance Company

The named insured requested a hearing to contest the nonrenewal of his homeowners insurance policy because the property was no longer owner-occupied and also because of his two criminal convictions. The company demonstrated that lack of owner occupancy affects the insurability of the property.
Held: For the company. 24-A M.R.S.A. § 3051 allows nonrenewal for a reason that is in good faith and related to the insurability of the property or if based upon a ground for cancellation under section 3049. The company established that the change in occupancy meets the standard for nonrenewal under section 3051. As the first stated reason provided grounds for nonrenewal, it was not necessary to address the merits of the second reason.
