Eileen Lorenz and Belle Crane v. MMG Insurance Company

The named insured requested a hearing to contest the nonrenewal of a homeowners insurance policy for continuing related losses. The company provided evidence of two similar losses, but did not establish that the losses were likely to continue.
Held: For the insured. 24-A M.R.S.A. § 3051 states that an insurer may nonrenew for a reason that is in good faith and related to the insurability of the property, but § 3050 states that “loss record” and “location” are not by themselves acceptable explanations of an intended nonrenewal. The insurer argued that similar wind losses were likely to continue because of the location of the home, but provided no information to connect the losses to the location. Accordingly, the nonrenewal was not approved.
