The named insured requested a hearing to contest the cancellation of homeowners insurance due to lack of interior inspection and loss control recommendations. The company testified that loss control recommendations were sent to the insured on April 23, 2010 at the same time the cancellation notice was sent to the insured. It was established that only 89 days was allowed for compliance before the intended cancellation date.
Held: For the insured. The Maine Property Insurance Cancellation Control Act allows cancellation of a homeowners policy for the insured’s failure to comply with reasonable loss control recommendations within 90 days after notice of the recommendations. As the 90 day period had not elapsed at the time of the company’s intended cancellation date, the cancellation action is not permitted. Additionally, the cited reason indicated that cancellation was due to recommendations, not the insured’s failure to comply with recommendations.
