The named insured requested a hearing to contest the cancellation of a commercial package insurance policy for a change in the risk that increases the risk of loss. The company was unable to establish that a change had occurred.
Held: For the insured. 24-A M.R.S.A. § 3007(2.C.) permits cancellation for a substantial change in the risk that increases the risk of loss since the policy was issued or renewed. The company had no evidence of any previous condition of the policy, but argued that it would not have been accepted if it had been in this condition when it was first issued. As the policy had been renewed, the condition at renewal must be established, and the change must have occurred since the renewal date. As the company could only establish the condition after the renewal, it did not establish any change increasing the risk of loss.
