Gary Jones v. Patriot Insurance Company

The named insured requested a hearing to contest the cancellation of his homeowners policy which alleged a negligent act by an insured which substantially increases any hazard insured against. The company argued that the insured failed to take steps to mitigate future losses and had a second loss from the same peril. The insured testified to the steps he had taken to mitigate this exposure.
Held: For the insured. 24-A M.R.S.A. § 3049(4) allows cancellation for discovery of a negligent act or omission by the insured that substantially increases any hazard insured against. The company failed to establish any act by the insured meeting this requirement, therefore the cancellation action failed.
