The personal representative of the insured’s estate requested a hearing regarding nonrenewal of the homeowners policy. The evidence shows the property is currently unoccupied, and relatives will use the property as a vacation home.
Held: For the company. The company demonstrated that the lack of occupancy by the named insured and also intermittent use of the property by relatives increase the hazards the homeowners policy insures against. 24-A M.R.S.A. § 3051 permits nonrenewal for a reason in good faith and related to the insurability of the property, and the company has met that standard.
