The named insured requested a hearing to contest the cancellation of a homeowners insurance policy for failure to comply with reasonable loss control recommendations. The company established that the insured has until May 2010 to comply.

Held: For the insured. 24-A M.R.S.A. § 3049(10) allows cancellation for an insured’s failure to comply with reasonable loss control recommendations within 90 days after notice of the recommendations. A company is free to establish a longer period of time to comply if it chooses. As the company indicated that the insured still had two months in which to comply with recommendations, there are no grounds for cancellation due to failure to comply at this time.
