Jennifer Amalfitano v. USAA Casualty Insurance Company

The insured requested a hearing to contest the nonrenewal of a dwelling fire policy. The company demonstrated at the hearing that the policy was written to cover a dwelling that was not owner-occupied and that the applicable statutory notice requirements were met.
Held: The matter was dismissed, as the evidence on the record demonstrated that the policy being nonrenewed was specifically written to cover a dwelling that was not owner-occupied. The policy therefore was not subject to the Maine Property Cancellation Control Act, which governs policies insuring residential property which is owner-occupied. As the governing statute is 24-A M.R.S.A. § 3007, which provides the right to a hearing only for mid-term cancellation actions, the company is allowed to nonrenew the policy without review.
