Richard and Joan Gordon v. Metropolitan Property & Casualty Insurance Company

Held April 18, 2009 – Docket No. INS-09-2080
Decision Issued: August 28, 2009

The insured requested a hearing to contest the nonrenewal of automobile insurance for accidents. The evidence presented at the hearing demonstrated that the cited accidents met the requirements for nonrenewal.

Held: For the company. Section 24-A M.R.S.A. § 2916-A(2) of the Maine Automobile Insurance Cancellation Control Act permits nonrenewal when one driver has two or more accidents within the 36 months prior to the annual anniversary date of the policy each of which exceeds $1,000 and is not within any of the statutory exceptions. The insured’s description of the accidents revealed that none of the exceptions applied, and did not dispute the amounts or dates cited by the company.
