MMG Insurance CompanyHeld April 1, 2009 – Docket No. INS-09-2022 The insured requested a hearing to contest the company’s nonrenewal of his homeowners insurance policy for specified conditions including missing siding, debris in the yard and failure to provide required underwriting information (questionnaires). As the underwriting questionnaires had been returned to the agent a month prior to the company’s issuance of the nonrenewal notice, that reason for nonrenewal was eliminated from consideration. Held: For the company. Other issues cited in the notice had been addressed or were explained sufficiently for the company to dismiss from its concern, but missing siding and debris stored outside for eventual disposal were established. As the policy provides coverage for wind and water damage and also coverage for injuries occurring on premises, those issues increase the hazards insured against and are therefore related to the insurability of the property.
