John Bernier v. York Insurance Company of Maine Held January 6, 2009 – Docket No. INS-08-2124 The insured requested a hearing to contest the company’s intended nonrenewal of his homeowners policy due to specific conditions of a barn on the premises. The company established that the barn’s condition presented increased exposures to several perils insured under the policy. Held: For the company. Although the company had erroneously identified the structure as detached, the specific conditions cited in the stated reason for nonrenewal were sufficient to identify the structure as no other structures met the description. As the homeowners policy provides coverage for the hazards increased by the barn’s condition, the reason was in good faith and related to the insurability of the property.
