Maxine & Robert King v. Middlesex Mutual Assurance Company

The company issued a notice of nonrenewal because of a dog bite incident. The evidence supported that a dog bite had occurred and the company paid the resulting claim. The dog remains in the household.

Held: For the company. 24-A M.R.S.A. § 3049(9) permits cancellation or nonrenewal for a loss occasioned by a dog bite, unless the insured removes the dog after receiving notice of impending cancellation or nonrenewal. As it was established that a loss did result from a dog bite and the dog remains on the premises, the nonrenewal is permitted as the company met all statutory requirements.
