The named insured requested a hearing to contest nonrenewal of his homeowners policy for several specified conditions of the property increasing the hazards insured against. The company established the existence of at least one of the listed conditions and that it increased the risk of loss under the policy.
Held: For the company. 24-A M.R.S.A. § 3051 allows nonrenewal of a homeowners policy for a reason that is in good faith and related to the insurability of the property. The company established that the roof is in extremely poor condition, increasing the likelihood of a loss. The homeowners policy provides coverage for water damage, thus this condition increases one of the hazards insured against. As statutory notice requirements were met, this nonrenewal is permitted under the Maine Property Insurance Cancellation Control Act.
