Keith & Virginia Christy v. National Grange Mutual Insurance Company
Hearing #2005-16065, Decision Issued May 10, 2005.

The insured requested a hearing following receipt of a notice of automobile insurance coverage nonrenewal citing a driver’s license suspension, two motor vehicle violations and an accident. At hearing, the company provided evidence of license suspensions incurred during the term of the expiring policy. The evidence was based upon a motor vehicle record from January 2005. The insured maintained that the referenced suspension and all related suspensions have since been deleted from the driver’s record. He submitted a document from the Maine Judicial Branch Violations Bureau indicating that the judgment on the suspensions had been reopened and dismissed and documentation from the Bureau of Motor Vehicles demonstrating that all suspensions have been deleted from the driver’s record.

Held: For the insured. The evidence indicates that the license was suspended in error, and therefore, the suspensions do not provide grounds for nonrenewal of the policy. In addition, the motor vehicle violations cited and the single accident do not meet any of the statutory grounds for nonrenewal.
