Douglas McMichael v. MMG Insurance Company

The insured requested a hearing following receipt of a notice of dwelling fire insurance coverage nonrenewal citing the failure to complete construction as the reason for nonrenewal. At hearing, the company maintained that the dwelling lacks siding thereby increasing the exposure to weather related damage. The insured maintained that it has not been possible to complete the siding yet.

Held: For the company. Although the policy provides limited coverage, the exposures are increased by the lack of siding. Accordingly, the company has demonstrated that the lack of siding is a good faith reason related to the insurability of the property.
